Count Bro is licensed, not sold. You may use it for your own lawful personal workout tracking.
1. Agreement to These Terms
These Terms of Service and License Agreement ("Terms") apply to Count Bro, a mobile workout tracking application operated by Hleb Shautsou ("Count Bro," "we," "us," or "our").
By downloading, installing, accessing, or using Count Bro, you agree to these Terms. If you do not agree, do not use the app.
2. Relationship to Other Legal Pages
These Terms explain your license to use Count Bro and the general rules for the app. Privacy and health matters are handled by separate pages:
- The Count Bro Privacy Policy explains what information the app handles and how privacy choices work.
- The Count Bro Health and Safety Disclaimer explains important fitness, medical, and exercise-risk information.
For privacy questions, the Privacy Policy controls. For health, medical, workout safety, and exercise-risk questions, the Health and Safety Disclaimer controls.
3. Your License to Use Count Bro
Count Bro is licensed to you, not sold. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Count Bro for your own lawful personal workout planning and workout tracking.
This license does not give you ownership of Count Bro, its code, design, branding, content, or other intellectual property.
4. Use Restrictions
You agree not to:
- Use Count Bro for unlawful, harmful, or abusive purposes.
- Copy, modify, distribute, sell, rent, lease, sublicense, or commercially exploit Count Bro except where allowed by law.
- Reverse engineer, decompile, or attempt to extract source code except where the law gives you a right to do so.
- Bypass app store payments, access controls, security protections, or technical limits.
- Interfere with Count Bro, app stores, operating systems, or services used to provide support, billing, updates, or app distribution.
5. Fitness, Health, and Exercise Risk
Count Bro is a fitness tracking and workout planning app. It is not a medical device, medical service, healthcare provider, or substitute for advice from a qualified medical professional.
Count Bro does not provide medical advice, diagnosis, treatment, rehabilitation plans, injury assessment, nutrition prescriptions, or professional health recommendations. You are responsible for deciding whether any workout, exercise, weight, repetition target, training intensity, or activity is suitable for you.
Exercise involves risk. You agree that you exercise at your own risk and should review the full Health and Safety Disclaimer before using Count Bro for training activity.
6. Local Data and Your Responsibility
The current version of Count Bro is designed around local workout tracking. Your profile, preferences, workout plans, exercise targets, workout history, and related app data are stored on your device unless your device, operating system, app store account, or backups handle them separately.
You are responsible for maintaining access to your device, protecting it with appropriate security settings, and managing any device or operating-system backups you choose to use. Deleting Count Bro, clearing device storage, resetting your device, disabling backups, or losing your device may result in loss of local app data.
We do not guarantee that workout data, settings, history, or other local app data will always be preserved, recoverable, or available. The Privacy Policy provides more detail about local storage, support communications, and privacy choices.
7. No Guarantee of Results or Accuracy
Count Bro can help you record plans, sets, reps, weights, workout completion, and training history. It does not guarantee any fitness, health, strength, weight, body composition, performance, habit, or training result.
App content, exercise details, summaries, calculations, and progress information may be incomplete, inaccurate, delayed, or not suitable for your goals or circumstances. You are responsible for checking your entries and using your own judgment.
8. App Store Billing, Purchases, and Refunds
If your version of Count Bro includes paid features, subscriptions, or in-app purchases, billing is handled by the app store or payment provider where you downloaded the app, such as Apple App Store or Google Play.
Purchase confirmation, renewal, cancellation, refund eligibility, taxes, payment methods, and billing support are controlled by the applicable store or payment provider. You should manage subscriptions and refund requests through the same store account used for the purchase.
9. Updates and Changes to the App
We may update, fix, improve, remove, suspend, or change Count Bro features from time to time. Some updates may be required for security, compatibility, store compliance, or continued app operation.
We do not guarantee that every feature, layout, exercise list, platform version, device, operating system, or app version will remain available or supported forever.
10. Third-Party Services and Platforms
Count Bro may rely on third-party platforms or services, including app stores, operating systems, device backup services, email providers, payment providers, and open-source software. Those third parties may have their own terms, privacy policies, support rules, billing rules, and technical limits.
We are not responsible for third-party platforms or services that we do not control.
11. Ownership
Count Bro, including its app code, design, branding, logos, text, layout, and related materials, is owned by us or our licensors and is protected by intellectual property laws.
You retain responsibility for the workout information and other data you enter into Count Bro, subject to the local storage and data responsibility terms above.
12. No Warranties
To the maximum extent permitted by law, Count Bro is provided "as is" and "as available." We do not make warranties that the app will be uninterrupted, error-free, secure, accurate, suitable for your goals, compatible with every device, or able to preserve or recover your data.
Some laws do not allow certain warranty exclusions. Nothing in these Terms limits rights you may have under laws that cannot be waived.
13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, workout history, profits, goodwill, device access, business opportunities, or fitness results arising from or related to Count Bro.
Nothing in these Terms excludes or limits liability where the law does not allow that exclusion or limitation, including rights that may apply to consumers in your location.
14. Termination
You may stop using Count Bro at any time. These Terms and your license to use Count Bro terminate automatically if you violate these Terms.
After termination, you must stop using Count Bro. Sections that by their nature should continue after termination will continue, including ownership, warranty disclaimers, limitation of liability, and local data responsibility provisions.
15. Legal Compliance and Consumer Rights
You are responsible for using Count Bro only where lawful and in compliance with applicable laws, including export control and sanctions laws.
These Terms are intended to apply to the maximum extent permitted by law. If consumer protection, app store, or local law gives you rights that cannot be limited by contract, those rights are not limited by these Terms.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and provide notice as required by applicable law or app store requirements. Continuing to use Count Bro after updated Terms apply means you accept the updated Terms.
